MY TOP TOUR carries out its activity as a wholesale-retail travel agency, dedicated to the intermediation and marketing of tourism services and products, with identification number C.I.AN-187008-3.

Purpose of the website

MY TOP TOUR makes available to the public (hereinafter, «user») accessing the WEBSITE information about its tourism services, as well as the possibility of booking and paying for those services directly through the channels enabled for that purpose (hereinafter, «CONTENT» and «SERVICES»). The WEBSITE is therefore both informative and transactional in nature.

The terms, conditions and procedure applicable to the electronic contracting of tourism services are governed by the General Terms and Conditions, which form an integral part of this Legal Notice for all purposes.

MY TOP TOUR may modify the content of this Legal Notice at any time. The applicable version shall be the one in force at the time of access, the date of the last update being indicated in all cases in the header of the document.

Correct use of the services

The user undertakes to use the Services diligently, correctly and lawfully. In particular, and by way of example only and without limitation, it is prohibited to:

• Use the Services for purposes or with effects contrary to the law, morality, generally accepted good customs or public order.
• Reproduce, copy, distribute, publicly communicate, transform or modify the Services or their content, except with the authorisation of the holder of the corresponding rights or where legally permitted.
• Infringe any intellectual or industrial property rights of MY TOP TOUR or of third parties.
• Use the information obtained through the WEBSITE to send advertising, direct sales communications or unsolicited messages addressed to a number of people, as well as to market or disclose such information.

Third-party links and content: the WEBSITE may include links to third-party platforms, including customer review management platforms such as Google Business Profile and Trustpilot. MY TOP TOUR neither controls nor assumes responsibility for the conditions, policies or content of those platforms, which are governed by their respective terms and conditions, without prejudice to the fact that MY TOP TOUR will endeavour to maintain reasonable consistency between the information published on those channels and on this WEBSITE.

The user shall be liable for any damages that MY TOP TOUR may suffer as a result of the breach of the above obligations or of any others set out in this document or in the applicable regulations.

Minors must use the WEBSITE under the supervision and with the consent of their father, mother or legal guardian, who shall be responsible for the purchases and uses made through them. The processing of any personal data collected is governed by the Privacy Policy.

MY TOP TOUR shall ensure compliance with the legal system in force and may, at its sole discretion and in a proportionate manner, interrupt the Service or exclude the user from the WEBSITE in the event of reasonable indications of the commission of offences classified in the Criminal Code, or of conduct contrary to these conditions that disrupts the operation, image or prestige of MY TOP TOUR.

Rules of conduct in the customer service

Users may contact MY TOP TOUR through its customer service, available by telephone every day of the week from 8:30 to 20:00, and by email on a permanent basis (24 hours, with no guaranteed response time), provided they respect the following code of conduct:

1. No user may impersonate another person or organisation. Identity theft may constitute an infringement or offence under the Spanish Criminal Code and Civil Code.
2. Disrespectful or offensive language may not be used. Messages containing threats, serious insults or comments that may be demeaning are not admissible. MY TOP TOUR reserves the right to remove such content and to take the corresponding legal action.
3. It is prohibited to use the customer service channel to present, quote or recommend third-party companies or web portals, or to carry out marketing actions or send unsolicited communications («spam»). MY TOP TOUR may delete such content and the responsible accounts, without prejudice to reporting the facts to the competent authorities (including, where appropriate, the Spanish Data Protection Agency) when the conduct may constitute an infringement of the regulations on unsolicited commercial communications.

Personal data provided through this channel will be processed in accordance with the provisions of the Privacy Policy.

Electronic contract with the customer

Everything relating to electronic contracting between the customer and MY TOP TOUR, including the purchase procedure, prices, method of payment, right of withdrawal and its exceptions applicable to tourism services, cancellations and other contractual conditions, is governed by the General Terms and Conditions of this WEBSITE, a document that the user must read and accept prior to booking.

Applicable law and jurisdiction

These conditions are governed by Spanish law.

For the resolution of any dispute that may arise in relation to this Legal Notice, the parties submit to the Courts and Tribunals of Granada (Spain), without prejudice to the mandatory jurisdictions that, in accordance with the applicable regulations, may correspond to the consumer on the basis of their domicile, and without prejudice to the mandatory consumer protection provisions applicable in their country of residence when this is outside Spain.

For consumers resident in the European Union, Regulation (EU) 1215/2012 shall apply where relevant, which may confer jurisdiction on the courts of the consumer domicile.
